Operating rules of the Zadní Hrádek Complex
Dear Guests, we hereby ask you to comply with the instructions set forth in these operating rules (hereinafter also referred to as the “Operating Rules”), and we trust that you will understand the restrictions listed below so that we can create a pleasant and safe environment for the operation of the facility.
This document summarizes the terms of use for the facility operated by Farma Zadní Hrádek s.r.o., ID No. 08462291, with its registered office at 28. října 767/12, Nové Město, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File No. 319327 (hereinafter referred to as the “Operator”), located at Červený Hrádek 111, 285 04 Bečváry - Červený Hrádek, , and the adjacent land (hereinafter referred to as the “ZH Complex”), for all persons using any part of the ZH Complex (hereinafter referred to as the “User”).
These Operating Rules set forth the conditions for the use of the ZH Complex and form an integral part of every lease, sublease, or similar agreement entered into between the Operator and the User, or, where applicable, with a third party for the benefit of the User, concerning the lease or sublease of the ZH Complex (hereinafter referred to as the “Agreement”).
In the event of a violation of these Operating Rules, the Operator is entitled to immediately terminate the relevant Agreement (or the relevant reservation agreement, as applicable).
Unless otherwise specified below, the rules and prohibitions set forth below apply to Users.
- General Rules for Use of the ZH Complex:
- No Open Fires. A strict ban on lighting fires applies throughout the ZH Complex, with the exceptions described below. Use of the fire pit or stove in the stable is permitted only after prior arrangement and training with an authorized employee of the Operator, and at the User’s own risk and responsibility. The Operator is not liable for any injury or property damage caused by the User to themselves, the Operator, or a third party. Fires may only be lit in designated areas (the fireplace and stove in the stable, the fireplace in the apartment, the fire pit and grill in the summer kitchen) intended for this purpose, during designated times, and with the utmost caution. Handling open flames is prohibited throughout the ZH Premises. Furthermore, the use of open-flame lighting devices, including candles, oil candles, candlesticks, lanterns, torches, burners, kerosene lamps, sparklers, etc., is prohibited throughout the ZH Premises without the Operator’s prior consent. Users are required to maintain a safe distance from open flames and the stove in the stable, specifically at least 1 m from the stove. The Operator expressly warns that failure to maintain this distance poses a risk of burns or other injuries.
- Restrictions on Entry. For the safety of guests at the ZH Complex, entry is prohibited to any areas of the ZH Complex other than those made available to Users under the Agreement. In particular, entry is prohibited to non-public areas of the ZH Complex, the ZH Complex’s back-of-house facilities, and areas reserved for staff. The Operator has the right to lock any common areas of the ZH Complex. Keys to these areas are kept by the Operator at a designated location. The Operator reserves the right to deny entry to the ZH Complex to Users who exceed the maximum number of guests agreed upon by the contracting parties in the Agreement (or in the request for quotation, which forms part of the Agreement).
- No Smoking. Smoking is strictly prohibited throughout the entire ZH Complex, except in areas designated and explicitly marked for that purpose. Inside the ZH Premises, this prohibition also applies to electronic cigarettes, vaporizers, and similar devices. In the event of a violation of this prohibition, the Operator is entitled to charge the User CZK 10,000 for each individual violation.
- Use of Electrical Appliances. All appliances and other items used on the ZH Complex premises must comply with applicable technical and safety standards. The Operator has the right to prohibit the use of appliances and other items, particularly with regard to the capacity of the electrical grid and safety. The User is authorized to use only single-phase appliances with a power consumption of up to 500 watts on the ZH Premises without the Operator’s prior express consent (in particular, the User is not authorized to connect any food trucks, compressors, air conditioners, etc., to the ZH Premises’ electrical grid without prior consent).
- No Animals. It is prohibited to bring or keep any animals on the ZH Premises without the Operator’s prior express consent. In the event that the Operator permits the presence of a pet on the ZH Premises, the User assumes full responsibility for the pet’s movements and behavior, including damage to the facility’s structures and equipment, movement in the immediate vicinity of stoves or open fires, and any attack on or threat to other Users of the ZH Complex and other pets present on the premises of the ZH Complex. Small breeds of dogs that do not pose a threat to the health or property of the Operator or third parties are permitted (without prior consent) on the ZH Complex premises.
- Cameras. The premises of the ZH Complex are monitored by a camera system for security purposes.
- Prohibition on Pyrotechnics. It is prohibited to bring into or store weapons, explosives, and explosive devices—including recreational pyrotechnics—on the ZH Premises. It is strictly prohibited to use or set off such items (fireworks, firecrackers, smoke bombs, etc.) on the ZH Premises or in its vicinity.
- Noise. Any audiovisual or musical performances or other noisy activities are permitted only inside the barn, subject to the Operator’s prior approval, and must comply with the Operator’s instructions regarding the time and noise level. Any noisy activity in outdoor areas is prohibited. In the event of a violation, the Operator is entitled to a contractual penalty of 20,000 CZK.
- Prohibition of Drugs. The use and possession of psychotropic and narcotic substances are strictly prohibited throughout the ZH Premises, unless they are medications prescribed to the User by a physician. A User under the influence of psychotropic or narcotic substances may be expelled from the ZH Premises or denied entry to the ZH Premises.
- Prohibition of Alcohol. The use and possession of alcohol are strictly prohibited throughout the ZH Premises without the prior express consent of the Operator.
- Use of Motor Vehicles. Entry to the ZH Premises is permitted only for motor vehicles traveling at a maximum speed of 20 km/h and only on designated paved areas. Parking is permitted exclusively in designated and marked parking spaces. Parking on the access road and in the courtyard area is prohibited.
- Emergency Exits. For fire safety reasons, it is strictly prohibited to place any objects in the emergency exit routes throughout the ZH Complex.
- Drone Ban. The use of unmanned aerial vehicles on the ZH premises without the prior consent of the Operator is prohibited.
- Supervision of Children. All Users under the age of 18 must be under the supervision of a parent, legal guardian, or other accompanying adult at all times during the event; such adult is fully responsible for them and acknowledges that they are obligated to pay for any damages caused by these Users.
- Other Prohibited Activities. Throughout the ZH Premises, all Users are prohibited from:
- engage in activities related to the adult entertainment or pornography industry, in particular the production of erotic or pornographic works, whether in photographic, film, computer, electronic, or any other form;
- engaging in commercial activities of a sexual nature, in particular prostitution or the provision of sexual services in any other form (e.g., remotely via the Internet);
- to make any audiovisual recordings or take photographs of any persons without their consent;
- engage in any other activity that would be in violation of these Operating Rules and/or the generally binding regulations of the Czech Republic;
- access the roof of any building on the ZH Campus;
- place or move objects, including furniture, plants, advertisements, and posters (in particular, removing interior furnishings to the outdoors);
- carry out construction or other modifications on the ZH Premises or attach decorations (e.g., by nailing or drilling);
- use any equipment on the ZH Premises for a purpose other than that for which it is intended;
- damage, move, or use fire extinguishers for any purpose other than extinguishing a fire; and
- to pollute the premises in any way.
- Additional Obligations of the User. The User is required to:
- maintain order and cleanliness throughout the ZH Complex and in its immediate vicinity, and use the ZH Complex (its individual buildings and areas) in a careful manner so as to prevent contamination, damage, or excessive wear and tear (dispose of waste only in designated areas);
- exercise increased caution during the winter months due to reduced traction and walkability of surfaces on the ZH Premises (black ice, snow, etc.);
- Store bicycles and strollers only in areas designated for this purpose by the Operator;
- notify the Operator immediately of the need for emergency repairs, as soon as a defect is discovered, by contacting the ZH Facility manager or, if necessary, by phone: (+420) [●];
- respect the rights and legitimate interests of other Users and the Operator;
- comply with the fire safety and evacuation plan as posted in the appropriate locations within the ZH Complex;
- notify the Operator of any damage or defects on the premises of the ZH Complex without undue delay after discovering them. If the damage or defect was caused directly or indirectly by the User, the Operator shall repair the damage or defect at the User’s expense;
- allow the Operator’s authorized employees to inspect all parts of the ZH Complex, including its equipment, and ensure its proper use; and
- in the event of causing any damage to the Operator, to compensate for such damage on the spot by cash payment or by transfer to the Operator’s bank account. Failure to comply with this obligation entitles the Operator to immediately terminate the Agreement or the relevant reservation agreement.
- Handover. Immediately after the conclusion of the event, the User is obligated to hand over the ZH Premises to the Operator in a condition corresponding to normal soiling and wear and tear given the nature of the event held.
- Penalties. Any contractual penalty is due within 7 days of a written demand for payment. All contractual penalties apply to individual breaches of the confirmed obligation, and in the event of a repeated breach, the right to an additional contractual penalty arises. In the event of a continuing breach, the right to a contractual penalty arises for every 15 minutes or part thereof that the breach of the confirmed obligation continues.
- Rules for Use of Indoor Premises
- The User may use the barn only for the purpose agreed upon in the Contract (or in the inquiry, which forms part of the Contract).
- The use of fog machines, wood-burning stoves, sprays, smoke bombs, and other similar devices that produce (artificial) fog or smoke in any form is strictly prohibited inside the premises.
- It is prohibited to remove any equipment from the premises without the prior consent of the Operator.
- The User is required to contribute to the efficient operation of the ZH Complex, particularly by not wasting water and energy.
- In the event of excessive soiling of bedding and upholstery, the User is responsible for it, and the Operator will charge the User for cleaning services in addition to the rental fee.
- With prior consent and training from the Operator, Users may use the table tennis tables and related equipment in the Barn. Users are required to return all equipment in its entirety to the Operator or to a location designated by the Operator after use.
- In the event of the loss of a key to the premises or a part thereof, which was loaned to the User by the Operator for the duration of the event, the User is required to report this fact to the Operator immediately. The Operator will then take the necessary steps to ensure the security of the premises, and the associated costs may be charged to the User in full.
- The User is required to store their personal belongings in a lockable area of the accommodation facilities and to lock them. The Operator is not liable for any damage resulting from the storage of items in other parts of the ZH Complex.
- Rules for Using Outdoor Areas
- All users are required to use the ZH Complex with care so as not to cause any damage to trees, plants, or animals located within the ZH Complex. Users may not enter areas of the ZH Complex reserved for animals without the Operator’s prior consent. Throughout the ZH Complex, there is a strict prohibition on climbing trees and on damaging or otherwise defacing vegetation within the ZH Complex and its immediate surroundings, particularly flower beds and the orchard.
- Without the Operator’s prior consent, feeding farm animals and any physical contact with them is prohibited.
- In the event that the Operator has permitted the presence of pets on the ZH Premises, the User is fully responsible for their movement and behavior within the designated agricultural area, particularly in the vicinity of farm animals.
- Throughout the ZH Complex, it is strictly prohibited to relieve oneself outside of the designated restroom facilities.
- To protect the environment and in accordance with the Fire Protection Act, it is strictly prohibited to release balloons, sky lanterns, and other flying objects—especially those with an open flame—within the ZH Complex and its immediate vicinity.
- In the event of adverse weather conditions, the User is required to exercise increased caution when moving about on outdoor paved areas, for example, due to ice or increased slipperiness of surfaces.
- If the contracting parties have agreed in the Contract (or in the request for quotation, which forms part of the Contract) to set up tents or other temporary lodging facilities on the ZH Premises, the User may do so only in the designated area and in accordance with the instructions issued by the Operator.
- Subject to prior approval and training by the Operator, Users may use the pétanque court and related equipment. Users are required to return all equipment in its entirety to the Operator or to a location designated by the Operator after use.
- Entry onto flower beds is prohibited.
- Rules for Using Water Areas
- The ZH Complex also includes water areas—a biotope pond and a small fishing pond. Without the Operator’s prior consent, it is prohibited to enter any water area or to use any watercraft located therein.
- Any use of the water areas by Users is at their own risk. The Operator is not liable for (i) the cleanliness of the water in the water areas, (ii) the condition of the bottom of the water areas, or (iii) the condition of the boat on the pond. The Operator does not exercise any supervision over the water areas. With the Operator’s consent, only swimmers may use the bodies of water. Persons under the age of 15 may use the bodies of water only under the supervision of a legal guardian or another person over the age of 18.
- Furthermore, it is prohibited to throw or place any objects into the water or to pour any liquids into it (e.g., using any cleaning products in the water). Only items specifically designed for use on the water (inflatable loungers, swim rings, etc.) are permitted. In the event of such a violation, the Operator is entitled to a contractual penalty of 50,000 CZK.
- Operator’s Liability
- The Operator is not liable for damage to items left in the ZH Complex outside the locked areas of the accommodations.
- Users must not leave money, high-value items, or other valuables unattended on the ZH Premises.
- Any claim by the User for compensation for damages must be filed with the Operator without undue delay, but no later than 5 days after the date on which the User became aware of the damage.
- The User waives any right to compensation from the Operator for property damage caused to the User by natural phenomena or by animals, unless such damage was caused by a culpable breach of the Operator’s obligations. The Operator is not liable for any damage incurred by the User in connection with a violation of these Operating Rules by any User.
